Since audio recordings of last week’s health-care arguments before the Supreme Court were released, the performance of Solicitor General Donald Verrilli has been criticized. But factors such as the number of times a lawyer is interrupted or hesitates while arguing in our nation’s highest court are not a sound basis for judging the “ Worst Week in Washington ” — or even for guessing how the court will ultimately rule. Those who understand the challenges of Supreme Court argument — people who have argued before the court — have not criticized Verrilli’s performance. 1 . The “individual mandate” forces everyone to buy health insurance. The law states that, beginning in 2014, individuals must ensure that they and their dependents are covered by health insurance. Taxpayers who do not meet this requirement will have to pay a penalty that the law calls a “shared responsibility payment.” It begins at $95 for the first year and never exceeds 2 1 / 2 percent of anyone’s annual taxable income. The trustees of Medicare last year projected that the program’s share of gross domestic product would increase from the current 3.7 percent to about 5 percent in 2030 and nearly 6 percent by 2050. THE OBAMA ADMINISTRATION appears to have found an elegant way out of its contraceptive problem — or, perhaps more to the point, to the political problem created by its approach to contraceptive coverage. As we wrote after the previous policy was announced last month, increased access to contraception is important; requiring contraception as part of the standard health insurance package, without deductibles or co-payments, makes sense. But given the strong objections of the Catholic Church to contraception, it also makes sense to exempt religious employers from having to spend their own money on a service that violates their moral views. The administration recognized the need for such a carve-out, but it erred in drawing it too narrowly, to cover churches but not Catholic hospitals, charities and other such religiously affiliated institutions.
